Outdoor Activity and Navigation Risk Acknowledgment and Release

READ CAREFULLY. THIS AGREEMENT AFFECTS LEGAL RIGHTS. IT INCLUDES AN ACKNOWLEDGMENT OF INHERENT RISKS, AN ASSUMPTION OF RISK, A LIMITED RELEASE OF CERTAIN CLAIMS, AND AN AGREEMENT TO USE INDEPENDENT JUDGMENT.

1. Parties, Triaka, and Incorporation

This Outdoor Activity and Navigation Risk Acknowledgment and Release (the “Risk Agreement”) is entered into between you and Alexander Abreu and Lissette Angomas Technologies LLC (the “Company,” “we,” “us,” or “our”), the entity that owns and operates the Triaka platform, mobile application, website, and related services (collectively, “Triaka” or the “Service”). Triaka is a trade and platform name used by the Company and is not a separate legal entity.

This Risk Agreement supplements and is incorporated into the Triaka Terms of Service. It applies when you access or use Triaka in connection with outdoor recreation, off-road activities, route discovery, route planning, route recording, maps, location-based features, location sharing, Group Caravan, user-created or imported routes, points of interest, or other outdoor, mapping, route, navigation-related, or activity-related functionality made available through the Service.

By using the features or engaging in the activities covered by this Risk Agreement, you acknowledge that outdoor and off-road activities may involve inherent and potentially serious risks and that Triaka is a technology and information platform that may assist users with maps, routes, location information, and related functionality but does not control the terrain, weather, road or trail conditions, third-party conduct, access rights, physical environment, or other real-world conditions encountered by users. The specific risks, responsibilities, limitations, and acknowledgments applicable to such use are described in the sections below.

If this Risk Agreement conflicts with the Terms of Service specifically with respect to an outdoor-activity, off-road, mapping, route, location, or navigation-related risk expressly addressed by this Risk Agreement, this Risk Agreement will control to the extent of that conflict. For all other matters, the Terms of Service will continue to apply. Capitalized terms not defined in this Risk Agreement have the meanings assigned to them in the Terms of Service.

Nothing in this Risk Agreement is intended to exclude, restrict, waive, or eliminate any right, remedy, duty, or liability that cannot lawfully be excluded, restricted, waived, or limited under applicable law.

2. Voluntary Participation and Personal Responsibility

You voluntarily choose whether, when, where, with whom, and how to participate in motorcycling, ATV or UTV use, four-wheel driving, off-road driving, mountain biking, cycling, hiking, trail activities, camping-related travel, overlanding, and other outdoor or recreational activities in connection with which you may use Triaka. Your participation in any such activity is voluntary and undertaken based on your own decisions and judgment.

You are solely responsible for determining whether a proposed activity, route, road, trail, terrain, destination, vehicle, equipment, weather condition, environmental condition, and level of difficulty are appropriate for you and your circumstances. This includes evaluating your training, experience, physical condition, health, judgment, licenses or permits, protective equipment, vehicle condition and capabilities, fuel or battery requirements, available supplies, communications capability, and ability to respond to changing or unexpected conditions.

You are also responsible for complying with applicable laws, traffic and trail rules, access restrictions, closures, posted signs, land-use requirements, and private-property rights, and for obtaining any permission, permit, license, or authorization required for the activity or area involved.

The Company does not control and generally does not independently inspect or verify the activity site, trail, road, land, terrain, weather, vehicle, equipment, participants, landowners, other users, cellular or satellite coverage, public authorities, emergency services, or other real-world conditions that may affect an activity.

The availability, display, recording, sharing, popularity, rating, or use of a route, waypoint, point of interest, map, location, or other feature through Triaka does not constitute an instruction, endorsement, certification, representation, or recommendation by the Company that you undertake an activity or that any route, road, trail, terrain, destination, or area is safe, lawful, open, accessible, passable, accurate, or suitable for you, your vehicle, or your intended activity.

You remain responsible for using independent judgment, observing actual conditions, following official signs and instructions, and deciding whether to begin, continue, modify, or discontinue an activity.

3. Known, Inherent, and Unpredictable Risks

Outdoor recreation, off-road activities, travel, route following, and related activities involve inherent, obvious, hidden, and unpredictable risks. Such risks may arise suddenly, may change without notice, and may be increased by remote locations, limited or unavailable communications, changing terrain, weather, darkness, visibility, user error, inaccurate or outdated information, mechanical or equipment problems, wildlife, or the acts or omissions of other persons.

Risks include, without limitation: collisions with vehicles, people, animals, trees, rocks, structures, or other objects; falls, rollovers, loss of control, and overturns; drowning; avalanche; landslide; rockfall; wildfire; lightning; flooding; extreme heat or cold; dehydration; altitude illness or other environmental exposure; wildlife encounters; unstable, steep, obstructed, eroded, flooded, icy, muddy, washed-out, damaged, or otherwise hazardous terrain; traffic and road hazards; mechanical, tire, battery, fuel, or equipment failure; becoming lost, stranded, separated from a group, or unable to return; entering private, restricted, closed, or hazardous property or areas; delayed, limited, or unavailable rescue or medical assistance; and the acts or omissions of other users, landowners, property operators, third parties, or emergency responders.

Technology-related risks may include loss, degradation, interruption, or unavailability of cellular, Internet, GPS, satellite, or other communications or positioning services; device malfunction, damage, loss, overheating, battery depletion, or incorrect settings; and inaccurate, incomplete, delayed, outdated, or unavailable map, route, waypoint, point-of-interest, elevation, weather, location, or other information.

Routes and other information available through Triaka may be created, recorded, imported, uploaded, modified, or shared by users or obtained from third-party sources. Conditions may have changed materially since a route or other information was originally recorded, created, uploaded, or last updated. A route that was previously passable, lawful, accessible, or suitable may later become closed, restricted, damaged, dangerous, impassable, privately controlled, or otherwise unsuitable.

Many of these risks arise from the inherent nature of outdoor and off-road activities, real-world conditions, the conduct of users or third parties, or circumstances beyond the Company’s reasonable control. Triaka does not create, control, supervise, inspect, or guarantee terrain, roads, trails, weather, access conditions, third-party conduct, vehicle or equipment condition, cellular, Internet, GPS, or satellite availability, emergency-response availability, or other external conditions encountered during an activity. Except to the extent responsibility cannot lawfully be excluded or limited, the existence or occurrence of such risks does not, by itself, mean that the Company caused, assumed responsibility for, or guaranteed protection against them.

These and other risks may result in serious bodily injury, illness, disability, death, becoming lost or stranded, property loss or damage, privacy or security harm, delay, expense, rescue or medical costs, or other economic or non-economic loss. Not every risk can be identified, predicted, displayed, warned against, or prevented in advance, and actual conditions may differ materially from information displayed or available through Triaka.

By voluntarily choosing to participate in an activity in connection with which you use Triaka, you acknowledge that these and other known, inherent, hidden, and unpredictable risks may exist. You remain responsible for evaluating actual conditions, taking appropriate precautions, complying with applicable laws and restrictions, and exercising independent judgment regarding whether to begin, continue, modify, or discontinue an activity.

4. Independent Verification and Safety Duties

You agree to exercise independent judgment and reasonable care and not to rely exclusively on Triaka when making decisions concerning safety, navigation, route selection, access, weather, terrain, road or trail conditions, emergency preparedness, or participation in any outdoor or recreational activity.

Information displayed or made available through Triaka may be incomplete, inaccurate, delayed, outdated, unavailable, or different from actual conditions. You remain responsible for independently verifying information that may materially affect your safety, access, route, or activity through appropriate sources and by observing actual conditions.

4.1 Before and During an Activity

Before and during an activity, you agree to take reasonable safety precautions appropriate to the activity and circumstances, including:

5. Maps, Routes, Navigation, Offline Data, and Sharing Limits

Maps, routes, points of interest, user reports, route descriptions, estimated travel information, elevation information, weather-related information, offline data, live-location information, alerts, and other geographic or activity-related information displayed or made available through Triaka may be delayed, incomplete, outdated, unavailable, inaccurate, or incorrect. Real-world conditions may change at any time, including after information has been created, recorded, uploaded, shared, displayed, or downloaded.

Triaka is an informational and technological tool and is not a substitute for official maps, posted signs, road or trail closure information, landowner instructions, government or land-management information, emergency notices, or the user’s independent judgment. The display or availability of information through Triaka does not constitute a representation or guarantee by the Company that such information is complete, current, accurate, or suitable for a particular activity or purpose.

Downloading a map, route, GPX or KML file, map tile, or other offline resource does not guarantee that the information will be complete, current, accurate, readable, or available for every portion of an activity. Offline functionality may be affected by the content previously downloaded, device storage, device or software limitations, GPS reception, battery level, file or data corruption, map-source availability, application updates, or other technical conditions. Users should not assume that downloading information for offline use eliminates the need for appropriate independent navigation, communication, or emergency preparation.

A route or other information created, uploaded, imported, recorded, shared, or published by another user constitutes user-generated or third-party information. Unless expressly stated otherwise by the Company, Triaka does not physically inspect, independently verify, certify, approve, supervise, or represent such a route or information as safe, lawful, open, accessible, passable, accurate, appropriate for a particular vehicle, suitable for a particular skill or experience level, or free from hazards, restrictions, closures, or private-property limitations.

Routes and related information may also become inaccurate or unsuitable after they are created or shared. Roads, trails, access rights, property boundaries, gates, closures, terrain, water levels, weather conditions, regulations, and other circumstances may change without notice. The fact that another user previously completed, recorded, rated, shared, or published a route does not mean that the same route can lawfully or safely be completed by another user or at another time.

Route planning, route display, map display, a waypoint, a point of interest, or the presence of a road, trail, path, or area within Triaka does not establish or grant any legal right of access or permission to enter or use property. A location appearing in Triaka may be private, restricted, temporarily or permanently closed, environmentally protected, damaged, hazardous, inaccessible, or otherwise unavailable. Users remain responsible for observing signs, gates, closures and actual conditions and for obtaining any authorization, permit, or permission required for access.

Location information, route guidance, estimated travel information, and other navigation-related information may be affected by GPS accuracy, device sensors, map data, network availability, software, user input, third-party services, environmental conditions, or other factors. Users must independently assess actual conditions and should not follow an instruction, route, or displayed path when doing so would be unsafe, unlawful, inconsistent with posted signs or official instructions, or beyond the capabilities of the user or vehicle.

Live location and other location-sharing features depend on factors that may be outside the Company’s reasonable control, including the sender’s device, permissions, GPS accuracy, battery level, Internet or mobile-data connectivity, backend and third-party service availability, and recipient access. A shared location does not guarantee real-time delivery, continuous updating, accuracy, receipt, monitoring by another person, or that a recipient will be willing or able to respond.

Group Caravan requires an active Internet or mobile-data connection for location updates and Caravan-related functionality. GPS availability alone does not guarantee that Caravan information will be transmitted or received. Loss, limitation, interruption, or instability of Internet connectivity may delay, interrupt, or prevent location updates, participant information, Help events, or other Caravan functionality.

The Help feature within Group Caravan is a communication and safety-support feature and is not an emergency-response, dispatch, monitoring, or rescue service. Activating Help does not automatically contact police, fire departments, emergency medical services, rescue organizations, 911, or other emergency authorities and does not guarantee that another user will receive, monitor, or respond to the Help event. Users must not rely on Triaka, Group Caravan, live-location sharing, or Help as their sole means of requesting or obtaining emergency assistance.

In an emergency or potentially life-threatening situation, users should contact the appropriate local emergency or rescue service through a reliable available method whenever possible.

6. User Reports and Community Information

Information and content supplied, created, uploaded, recorded, shared, or published by users through Triaka, including route conditions, comments, photographs, ratings, difficulty descriptions, hazard reports, closure reports, points of interest, waypoints, route descriptions, access information, and other observations or community-provided information, constitute user-generated content and may be subjective, incomplete, inaccurate, outdated, misleading, unavailable, or based on conditions that have changed since the information was originally submitted.

Triaka does not guarantee the accuracy, completeness, reliability, timeliness, safety, or continued validity of user-generated content. Users are responsible for independently verifying material information before relying on it and for comparing information available through Triaka with actual conditions, posted signs, official notices, applicable restrictions, weather conditions, landowner instructions, and other appropriate sources.

A rating, comment, photograph, report, route completion, popularity indicator, or other contribution by another user does not constitute a representation, certification, inspection, endorsement, or guarantee by the Company that a route, road, trail, location, point of interest, condition, or activity is safe, lawful, open, accessible, passable, accurate, appropriate for a particular vehicle or skill level, or free from hazards or restrictions.

The Company may, but is not obligated to except where required by applicable law, review, moderate, investigate, restrict, disable access to, or remove user-generated content in accordance with the Triaka Terms of Service, Community Guidelines, applicable law, or other applicable policies. The presence of content on Triaka does not mean that the Company has reviewed, verified, approved, or endorsed it, and the moderation or removal of content does not constitute a safety inspection, certification, or endorsement of any underlying route, location, activity, condition, or information.

Users should not assume that the absence of a hazard report, closure notice, negative comment, warning, or other community report means that a route, trail, road, location, or activity is free from hazards, restrictions, closures, access limitations, or other risks. Conditions may exist or change before they are reported to Triaka or reflected in the Service.

Users remain responsible for exercising independent judgment and reasonable care when deciding whether to rely on community-provided information or whether to begin, continue, modify, reroute, or discontinue an activity.

7. Assumption of Risk

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU KNOWINGLY AND VOLUNTARILY ACKNOWLEDGE AND ASSUME THE RISKS OF YOUR OUTDOOR, OFF-ROAD, RECREATIONAL, AND RELATED ACTIVITIES AND OF RELYING ON OR USING THE SERVICE IN CONNECTION WITH THOSE ACTIVITIES, INCLUDING THE KNOWN, INHERENT, HIDDEN, AND REASONABLY FORESEEABLE RISKS DESCRIBED IN THIS RISK AGREEMENT. THIS ASSUMPTION OF RISK INCLUDES RISKS ARISING FROM REAL-WORLD CONDITIONS, CHANGING OR UNEXPECTED CONDITIONS, THE ACTS OR OMISSIONS OF USERS OR THIRD PARTIES, AND, TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, BUT DOES NOT INCLUDE ANY RISK, CLAIM, DUTY, OR LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT YOU TO ASSUME, RELEASE, WAIVE, OR LIMIT.

Your assumption of risk applies to your voluntary decision to participate in an activity and to your use of or reliance on maps, routes, route-planning information, recorded or imported routes, points of interest, location information, elevation or weather-related information, offline resources, user-generated content, community reports, location-sharing features, Group Caravan, Help, and other mapping, navigation-related, location-based, or activity-related functionality made available through Triaka.

You acknowledge that maps, routes, user-generated information, location information, communications, GPS, Internet or mobile-data connectivity, offline resources, and other features or information may be inaccurate, incomplete, delayed, outdated, interrupted, unavailable, or materially different from actual conditions. You further acknowledge that real-world conditions may change without notice and that the Company does not control many of the external conditions and third parties that may affect an activity.

You understand and accept that your use of Triaka does not eliminate or transfer to the Company the risks inherent in your chosen activity. You remain responsible for evaluating actual conditions, independently verifying material information where appropriate, preparing for reasonably foreseeable risks, complying with applicable laws and access restrictions, and deciding whether to begin, continue, modify, reroute, or discontinue an activity.

Nothing in this Section is intended to require you to assume, release, or waive liability for gross negligence, reckless or intentional misconduct, or any other conduct, right, claim, or liability that cannot lawfully be released, waived, assumed, or limited under applicable law.

8. Limited Release and Covenant Not to Sue

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE COMPANY, ITS AFFILIATES, AND THEIR RESPECTIVE OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FOR CLAIMS, LIABILITIES, LOSSES, DAMAGES, COSTS, OR EXPENSES ARISING FROM OR RELATING TO THE KNOWN, INHERENT, OR REASONABLY FORESEEABLE RISKS OF OUTDOOR, OFF-ROAD, RECREATIONAL, OR RELATED ACTIVITIES DESCRIBED IN THIS RISK AGREEMENT, INCLUDING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY IN CONNECTION WITH THE SERVICE OR AN ACTIVITY.

This limited release applies, to the extent permitted by applicable law, to claims arising from or relating to your voluntary participation in an activity and your use of or reliance on maps, routes, route-planning information, recorded or imported routes, points of interest, user-generated content, community reports, offline resources, GPS or location information, location-sharing features, Group Caravan, Help, and other mapping, navigation-related, location-based, or activity-related functionality made available through Triaka, including risks arising from inaccurate, incomplete, delayed, outdated, interrupted, or unavailable information or functionality.

THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESSNESS, WILLFUL OR INTENTIONAL MISCONDUCT, FRAUD, OR ANY DUTY, RIGHT, CLAIM, REMEDY, OR LIABILITY THAT CANNOT LAWFULLY BE RELEASED, WAIVED, EXCLUDED, OR LIMITED UNDER APPLICABLE LAW. NOTHING IN THIS RISK AGREEMENT IS INTENDED TO ELIMINATE OR REDUCE ANY NON-WAIVABLE RIGHT OR REMEDY AVAILABLE TO YOU UNDER APPLICABLE LAW.

This Risk Agreement does not release, waive claims against, or otherwise provide a release for an unaffiliated user, landowner, property owner or operator, vehicle or equipment manufacturer, guide, tour operator, emergency responder, government entity, mapping or technology provider, or other independent third party merely because information concerning that person or entity appears in, is transmitted through, or is accessed through Triaka.

The presence of a third party, route, location, business, service, point of interest, or other information within Triaka does not, by itself, establish that the Company owns, controls, supervises, endorses, represents, or accepts responsibility for that third party or its acts, omissions, property, services, products, or activities.

This Section is intended to allocate only those risks and claims that applicable law permits the parties to allocate, release, waive, or limit and shall be interpreted accordingly.

9. No Emergency, Rescue, or Monitoring Service

TRIAKA IS NOT AN EMERGENCY DISPATCHER, RESCUE ORGANIZATION, MEDICAL SERVICE, PERSONAL LOCATOR BEACON, SATELLITE RESCUE DEVICE, OR SUBSTITUTE FOR 911 OR ANY APPLICABLE LOCAL EMERGENCY OR RESCUE SERVICE. Triaka does not guarantee that any person, including another user or Group Caravan participant, is monitoring your location, route, account, messages, Help event, or live-location sharing session, or that any person will receive, view, acknowledge, or respond to information transmitted through the Service.

Group Caravan, including its Help feature, requires an active Internet or mobile-data connection to transmit and receive location information, Help events, and other Caravan-related information. GPS availability alone does not guarantee transmission or receipt. Connectivity may be limited, interrupted, delayed, or unavailable because of terrain, geographic location, network coverage, device condition, battery level, permissions, software, third-party services, or other circumstances.

The Help feature within Group Caravan allows a participant to indicate through Triaka that assistance may be needed and to make applicable location information available through the feature. Help is a communication and safety-support feature; it is not an emergency-response, dispatch, monitoring, or rescue service. Activating Help does not automatically contact police, fire departments, emergency medical services, rescue organizations, 911, or any other emergency authority or responder. Triaka does not guarantee that a Help event will be successfully transmitted or received, that another participant or person will monitor or respond to it, or that assistance or rescue will be available or arrive within any particular period of time.

Location information associated with a Help event may be retained for safety and emergency-related purposes in accordance with Triaka’s applicable privacy and location-data policies and, where permitted or required by applicable law, may be preserved or disclosed to competent law-enforcement, emergency-response, rescue, or other authorized public authorities in connection with a legitimate emergency, missing-person situation, rescue effort, investigation, or other safety-related request.

DO NOT DELAY CONTACTING APPROPRIATE EMERGENCY OR RESCUE SERVICES BECAUSE OF TRIAKA, GROUP CARAVAN, OR HELP. IN AN EMERGENCY OR POTENTIALLY LIFE-THREATENING SITUATION, USE THE MOST RELIABLE AVAILABLE METHOD TO CONTACT THE APPROPRIATE LOCAL EMERGENCY OR RESCUE AUTHORITY. DO NOT RELY ON TRIAKA OR HELP AS YOUR ONLY METHOD OF REQUESTING ASSISTANCE.

10. Location Sharing and Privacy-Related Risk

Sharing a route, live location, waypoint, photograph, activity, Group Caravan information, or other geographic or location-related information through Triaka may reveal your current location, places you have visited, routes you have traveled, places you may intend to visit, or locations associated with you. Depending on the information shared, it may also reveal information about companions or other persons associated with an activity.

You are responsible for selecting the audience or recipient with whom you choose to share location-related information and for considering the privacy and safety implications before sharing it. Only share precise or live-location information with persons or groups you intend and trust to receive it.

A recipient who is authorized to view information through Triaka may be able to view, copy, screenshot, record, save, forward, reproduce, or otherwise disclose that information after receiving it. Once information has been received or independently captured by an authorized recipient outside the Service, the Company cannot control that recipient’s subsequent use, retention, copying, or disclosure of the information.

You must not intentionally use Triaka to track, stalk, harass, threaten, intimidate, surveil, endanger, or unlawfully monitor another person. You must not share another person’s precise location or other sensitive location information without appropriate permission or other lawful authority, and you are responsible for ensuring that content you upload or share does not unlawfully expose another person’s location or private information.

Users should exercise particular care when sharing information that could reveal a home, workplace, school, regularly visited location, private property, sensitive destination, or other location where disclosure could create a privacy or safety risk.

Location-sharing functionality may also be affected by device permissions, GPS accuracy, battery level, Internet or mobile-data connectivity, software, backend or third-party service availability, and other technical conditions. A displayed or shared location may be delayed, inaccurate, incomplete, unavailable, or different from a person’s actual current location.

Additional information regarding how Triaka collects, processes, retains, shares, and protects location information, including applicable user choices and rights, is provided in the Triaka Location Data Policy and Privacy Policy.

11. Third-Party Services and External Applications

Triaka may rely on, integrate with, obtain information from, or otherwise interact with third-party services and technologies, including mapping, routing, geolocation, points-of-interest, elevation, weather, operating-system, communications, infrastructure, payment, notification, and other technology providers. Third-party information, data, and services may be subject to their own terms, limitations, availability, accuracy, coverage, technical requirements, and privacy practices.

The Company does not control independent third-party providers and does not guarantee that third-party information or services will be accurate, complete, current, uninterrupted, secure, available, or suitable for a particular activity or purpose. A third-party service may experience errors, outages, delays, changes, discontinuation, coverage limitations, or other conditions outside the Company’s reasonable control that may affect functionality available through Triaka.

Information obtained from third-party sources, including maps, routing information, points of interest, elevation data, weather-related information, imagery, or other geographic information, should not be treated as a guarantee of actual conditions. Users remain responsible for observing real-world conditions and independently verifying material safety, access, and navigation information when appropriate.

Triaka may also allow you to voluntarily open or interact with an unaffiliated external application or service, including an external navigation, mapping, or sharing application. When you choose to leave Triaka or open an external service, your interaction with that service, including information transmitted to it, becomes subject to that provider’s own terms, privacy practices, functionality, and controls.

The Company does not control an unaffiliated provider’s navigation instructions, routing decisions, content, availability, accuracy, safety performance, data processing, privacy practices, or subsequent use of information transmitted to or processed by that provider. The availability of a link, integration, or option to open a third-party service through Triaka does not, by itself, constitute an endorsement, certification, or guarantee of that provider or its services.

Nothing in this Section is intended to exclude or limit responsibility that cannot lawfully be excluded or limited under applicable law. Additional information regarding third-party providers that process personal or location information in connection with Triaka is provided in the applicable Triaka Privacy Policy and Location Data Policy.

12. Age Requirement and Capacity

You must be at least 18 years of age to create a Triaka account, access or use the Service, or accept this Risk Agreement. Triaka is intended solely for adults and is not intended for use by minors.

By creating an account, accessing or using Triaka, or accepting this Risk Agreement, you represent and warrant that you are at least 18 years old and have the legal capacity and authority to enter into and be bound by this Risk Agreement and the Triaka Terms of Service.

A parent, guardian, or other person may not authorize or permit a minor to create or use a Triaka account when doing so would violate the age requirements of the Service. The fact that a parent, guardian, or other adult provides permission does not waive or modify Triaka’s minimum-age requirement.

If the Company reasonably determines that an account is being used by a person who does not satisfy the applicable age or legal-capacity requirements, the Company may restrict, suspend, or terminate the account and take other appropriate measures consistent with the Triaka Terms of Service, Privacy Policy, and applicable law.

Nothing in this Section limits any additional eligibility requirements that may apply under applicable law.

13. Electronic Acceptance and Records

By separately selecting the acceptance control presented for this Risk Agreement, you affirmatively confirm that you are at least 18 years of age; that you have been provided access to this Risk Agreement; that you have had the opportunity to review and understand it before accepting; that you understand that it contains an acknowledgment and assumption of certain risks and a limited release of certain claims; and that you knowingly and voluntarily agree to be bound by its terms.

Acceptance of this Risk Agreement is required to create a Triaka account and use the Service. If you do not agree to this Risk Agreement, you must not select the acceptance control, and you will not be permitted to create an account or use Triaka.

Your electronic acceptance constitutes an affirmative electronic action intended to evidence your agreement to this Risk Agreement. The Company may maintain records reasonably appropriate to document that acceptance, including the version of the Risk Agreement presented and accepted, the date and time of acceptance, the account identifier associated with the acceptance, and the affirmative acceptance action taken.

Where lawfully collected and reasonably appropriate, the Company may also maintain technical information associated with the acceptance, such as IP address, device information, application version, or similar technical records, for evidentiary, security, compliance, fraud-prevention, or recordkeeping purposes, consistent with the Triaka Privacy Policy and applicable law.

You acknowledge that electronic records of your acceptance may be used to demonstrate that this Risk Agreement was presented to and affirmatively accepted by you, subject to applicable law.

If the Company makes a material revision to this Risk Agreement that materially changes the allocation or acknowledgment of risk, the scope of any release, or other rights or obligations addressed by this Risk Agreement, the Company may require you to review and affirmatively accept the revised Risk Agreement before continuing to use the Service. Where applicable law requires renewed consent or acceptance, the Company will obtain it as required.

14. Relationship to Other Triaka Policies

This Risk Agreement should be read together with the Triaka Terms of Service, Privacy Policy, Location Data Policy, Community Guidelines, and any feature-specific disclosures or other policies that apply to the activity, functionality, or information you use or provide through the Service.

Privacy and the collection, use, retention, disclosure, and other processing of personal and location information are governed principally by the Triaka Privacy Policy and Location Data Policy. User conduct, user-generated content, and community rules are governed principally by the Triaka Terms of Service and Community Guidelines.

This Risk Agreement supplements and forms part of the contractual terms governing your use of Triaka. If a provision of this Risk Agreement conflicts with another Triaka policy regarding a risk specifically addressed by this Risk Agreement, this Risk Agreement will control with respect to that specific risk to the extent of the conflict, unless applicable law requires otherwise.

The governing-law, jurisdiction, venue, dispute-resolution, arbitration, class-action waiver, and related provisions, if any, contained in the Triaka Terms of Service apply to this Risk Agreement and to disputes arising out of or relating to this Risk Agreement to the extent permitted by applicable law. This Risk Agreement does not create a separate or inconsistent governing-law or dispute-resolution framework.

Nothing in this Risk Agreement expands any assumption of risk, waiver, release, limitation of liability, or covenant not to sue beyond the maximum extent permitted by applicable law, nor does it waive or limit any right, remedy, duty, or liability that cannot lawfully be waived, released, excluded, or limited.

15. Governing Law, Severability, and Nonwaivable Rights

This Risk Agreement is governed by and construed in accordance with the governing-law provisions set forth in the Triaka Terms of Service. Any dispute, claim, or controversy arising out of or relating to this Risk Agreement, its acceptance, interpretation, enforceability, or application will be subject to the applicable dispute-resolution, jurisdiction, venue, arbitration, and related provisions of the Triaka Terms of Service, to the maximum extent permitted by applicable law.

To the extent applicable to a particular activity, claim, or circumstance, laws concerning recreational activities, assumption of risk, releases, waivers, or allocation of inherent recreational risks, including potentially applicable Wyoming law, may affect the rights and responsibilities of the parties. The Company does not represent or warrant that any particular recreational-risk statute applies to every Triaka feature, activity, user, location, or circumstance, and the validity or enforceability of this Risk Agreement does not depend exclusively on the applicability of any such statute.

If any provision of this Risk Agreement is determined by a court or other tribunal of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be interpreted, modified, or limited to the minimum extent necessary to make it valid and enforceable where permitted by law. If it cannot lawfully be modified or enforced, the affected provision or unenforceable portion will be severed, and the remaining provisions of this Risk Agreement will remain in full force and effect to the maximum extent permitted by applicable law.

Nothing in this Risk Agreement is intended to waive, restrict, exclude, or limit any consumer right, statutory protection, remedy, duty, or liability that cannot lawfully be waived, restricted, excluded, or limited under applicable law.
